Many UK nationals move to Dubai to benefit from the UAE’s zero personal income tax regime. However, living outside the UK does not automatically exempt you from UK tax obligations. Whether you need to file a UK self-assessment tax return while living in Dubai depends on several key factors, which are outlined below.

UK residency status is a key determinant

Determining your UK tax obligations while living in Dubai begins with establishing whether you are still considered a UK tax resident. This is assessed under the Statutory Residence Test (SRT), which evaluates factors such as:-

  • Whether your move to Dubai is for full-time employment.
  • The number of days you spend in the UK during each tax year, and how many of those days involve UK-based work.
  • The number of UK ties you maintain, such as family, accommodation, or work connections.

If you are considered non-UK resident for a given tax year under the SRT, you are generally only liable to UK tax on your UK-sourced income or gains, and not on income or gains arising overseas.

However, if you are still considered UK resident while living in Dubai, you may be subject to UK tax on your worldwide income or gains, regardless of your physical location.

When you may need to file a UK tax return while living in Dubai

Even while residing in Dubai, you may still be required to file a UK self-assessment tax return if any of the following apply:-

  • You receive UK-sourced income.
  • You realise capital gains from UK land or property.
  • You realise capital gains from other UK-situs assets (i.e. shares in UK companies), particularly if you are subject to the temporary non-residence rules.
  • You receive a notice to file from HMRC – If HMRC issues a notice requiring you to complete a tax return, you must comply, even if you have no UK income or gains. In such cases, you should contact HMRC to have your filing obligation removed, rather than ignoring the notice, as failure to respond could result in penalties for late submission.

When you do not need to file a UK tax return

You may not need to file a UK tax return if all of the following apply:-

  • You are considered non-UK resident for the relevant tax year under the SRT;
  • You have no UK-sourced income or gains during that tax year; and
  • HMRC has not issued a notice to file a tax return.

It is advisable to maintain detailed records and review your residency status each tax year, particularly if your circumstances change – such as making more frequent visits to the UK, occasionally working there, starting a UK-based business, or working remotely for a UK-based employer.

Should I notify HMRC if I am non-UK resident?

When you leave the UK, you should notify HMRC by filing form P85 or by completing the ‘residence’ section of your UK self-assessment tax return. This allows HMRC to update your residency status and, where appropriate, remove your reporting or filing obligations.
